1. Who these terms are with

brewd is made by two people: Jordon de Hoog, in Ontario, Canada, and Madison Kirby, in Portland, Oregon. These terms are an agreement with Jordon de Hoog, as an individual, who is the party responsible for brewd. In these terms, "we" and "us" mean the two of us, and "you" means you, the person using brewd.

By downloading brewd, using it, or using this website, you agree to these terms. If you do not agree with them, please do not use brewd.

2. What brewd is

brewd is a coffee journal. You log the drinks you have, how you took them, how much you loved them, a note and a photo if you want one, and where you were. It keeps a wishlist, works out punchcards from your own journal, and helps you find cafés nearby.

It is a private record, not a review site. Nothing you write is published or shared with other users, because there is nowhere in brewd for that to happen. If you turn on sync, a copy sits on our server, and the privacy policy is exact about what that does and does not mean.

3. Who can use brewd, and your account

You need to be at least 13 years old, or at least 16 if you are in the EEA or the UK. You also need to be old enough where you live to enter into a contract on your own. If you are not, a parent or guardian has to agree to these terms for you.

You must not use brewd if the law where you live says you cannot.

An account is optional, and brewd works without one. If you make one, give us an address you can actually receive mail at, keep it and your password to yourself, and tell us atsupport@getbrewd.app if you think someone else has got into it. Anything done through your account is treated as done by you. Do not make an account for anyone else, or pretend to be someone you are not.

4. Your journal is yours

You own everything you put into brewd: your entries, your notes, your taste tags and your photos. We claim no ownership of any of it, and we do not use it for anything.

It is stored on your phone. Unless you turn on sync, it stays there and we hold no copy of it, which also means we cannot get it back for you. If you delete the app, lose your phone, or your device backup fails, your journal is gone and there is nothing on our side to restore from. brewd is not a backup service, so please keep your own device backups if that matters to you.

If you turn on sync. Sync is part of brewd+ and it is off until you switch it on. When you do, you give us a limited, non-exclusive, worldwide, royalty-free licence to store, transmit and restore your content, for the sole purpose of syncing it between your own devices and giving it back to you. That is the entire purpose. Not to publish it, not to show it to anyone, not to advertise with it, and not to train any model on it. The licence lasts only while your content is on our server, and ends when you delete the content or your account. Turning sync off, or letting brewd+ lapse, stops the copy changing but does not remove it. Our privacy policy sets out exactly what is stored, for how long, and the honest limits of the encryption.

You are responsible for what you put into brewd. By turning on sync you confirm that what you upload is yours to upload and does not break the law, and you accept that we may remove content we are legally required to remove. The licence extends to the providers who host brewd for us, and to nobody else.

5. brewd+

brewd+ is the paid tier. What it unlocks is whatever the upgrade screen described at the moment you bought it. That screen is the offer, and these terms do not add to it or take away from it. What brewd+ includes can change over time, and any change applies from when it is announced, not retroactively to what you were already sold.

• Apple and Google sell it, not us. Your purchase is made through the App Store or Google Play, under their terms and with their payment methods. We never see your card details.
• Price and renewal are shown before you confirm. The price, currency, billing period and renewal terms appear on the store's own purchase sheet. If you buy an auto-renewing subscription, it renews at the end of each period until you cancel it.
• You cancel in your store account. Cancel at least 24 hours before the next renewal, in your App Store or Google Play subscription settings. Settings, then help and subscriptions, will take you there. Deleting the app does not cancel a subscription.
• Refunds are the store's to give. We cannot issue them, because we never took the payment. Ask Apple or Google under their refund policies, and write to us if you want help.
• If a subscription lapses, brewd+ features stop and everything else keeps working. The journal on your phone is never touched by a billing change, and neither is anything you had already synced: it stops updating and waits for you.

6. Using brewd fairly

brewd has no social features, so this list is short. It is about our server, which the two of us pay for ourselves. Please do not:

• attack, overload or interfere with our server, or work around the rate limits on it
• bulk download or scrape the café index, the drink catalog or the map tiles, or redistribute them as your own
• try to unlock brewd+ without paying for it, including by faking or tampering with entitlements
• reverse engineer the app, except where the law expressly gives you that right
• use brewd for anything unlawful

If we have to protect the service or other people, we may rate limit, suspend or block access. We will keep that proportionate.

7. Third-party content

Some of what you see in brewd comes from other people, and stays theirs.

• Maps. Map data is © OpenStreetMap contributors, available under the Open Database License (ODbL). Tiles are built with Protomaps and served from our own storage.
• Cafés. Café details come from our own index built from OpenStreetMap data, and, where that index is thin, from Geoapify. Their data remains theirs, under their own licences and terms.
• The app itself is distributed by Apple and Google, and your use of their stores is governed by their terms as well as these.

We do not verify café information. Names, addresses, opening hours and whether a place still exists can all be wrong or out of date. Please check with the café before you rely on it, and treat what brewd shows you as a starting point rather than a fact.

8. What is ours

The brewd name, the logo, the app, its design and the content we write are ours, or used with permission. We give you a personal, non-transferable, non-exclusive licence to use brewd on devices you own or control, for your own personal and non-commercial use. Please do not sell it, rent it, sublicense it, or pass it off as something you made.

If you send us an idea or a suggestion, we may use it to improve brewd, with no obligation and no payment. That does not take away any rights you already hold in something you had made before you told us about it.

9. Changes to brewd and to these terms

We may modify, suspend or discontinue brewd, or any part or feature of it. For the free app we may do that at any time, with or without notice.

brewd+ is different, because you paid for it. If we discontinue brewd, or take away something brewd+ included at the moment you bought it, we will tell you in the app at least 30 days beforehand, you can cancel through your store, and anything you had synced stays available to ask us for throughout those 30 days.

We may also update these terms. When we do, we will change the effective date at the top of this page, and anything significant will also be announced in the app. Continuing to use brewd after a change means you accept the updated terms. If you do not accept them, stop using brewd and cancel any subscription through your store.

10. Ending things

You can end this agreement whenever you like: stop using brewd, delete the app, cancel any subscription in your store account, and, if you have an account with us, delete it from Settings in the app, or with the account deletion form on this site if the app is gone. We can suspend or end your access if you break these terms, or if we are required to by law. If that happens, the licence in section 8 ends, and the journal on your phone stays exactly where it always was, because it is yours. A suspension pauses your access and deletes nothing. If we end your account altogether we will tell you why and give you 30 days to ask for a copy of anything you had synced before it is deleted.

The sections that are meant to outlive the agreement do: what is ours, the disclaimers, the limits on liability, and the governing law.

11. No warranty

brewd is provided as it is, and as available, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not promise that brewd will be uninterrupted, error free, or available at any particular time, that the café or map information is accurate, or that any defect will be fixed. Some places do not allow these exclusions, and where that is true of yours, this section applies only as far as the law lets it.

12. Limits on liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for lost profits or lost data, including a journal we hold no copy of and a synced journal we do.

Our total liability to you, for everything arising out of or relating to brewd, is limited to the greater of the amount you paid for brewd in the 12 months before the claim, and CAD $50.

None of that limits liability which cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or under Ontario's Consumer Protection Act and any mandatory consumer protection law that applies where you live.

13. Governing law, and where a dispute goes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario are where we would bring or answer a claim.

If you are a consumer, none of that takes anything away from you. You keep the mandatory protections of the law where you live, and where that law gives you the right to bring a claim in your local courts, you keep that right too.

There is no mandatory arbitration clause in these terms, and no waiver of your right to take part in a class action.

14. Odds and ends

• If any part of these terms turns out to be unenforceable, the rest of it stands and that part is read as narrowly as it needs to be.
• If we do not enforce something straight away, we have not given up the right to enforce it later.
• You may not transfer your rights under these terms. We may transfer ours if brewd changes hands, and your rights come with it.
• These terms, the privacy policy, and the offer shown on the upgrade screen are the whole agreement between us about brewd.
